Family Law Mediation & Arbitration in Denver
Not all family law issues require a fight in the court. If you’re looking at mediation or arbitration to resolve your family law issue, Thrive Family Law in Denver is here to help.
What is Mediation?
In mediation, a neutral third-party mediator helps both parties negotiate and reach a mutually acceptable agreement. This process is voluntary and confidential, which can be valuable in cases where privacy is important. Unlike a judge, a mediator doesn’t make decisions. Instead, a mediator facilitates discussion between both parties to help them reach a resolution.
Because mediation avoids litigation, you can save on legal fees and court costs and generally receive a faster resolution. Mediation also offers greater control, as you get to actively participate in creating the agreement rather than having a judge decide.
Mediation is commonly used for divorce; child custody disputes; alimony and child support; and property and asset division.
What is Arbitration?
Arbitration is a more structured alternative to litigation, where a neutral arbitrator (often an experienced attorney or retired judge) hears both sides of the dispute and makes a decision.
Like mediation, arbitration is often quicker and less expensive than litigation. While arbitration is a structured process, it can be more flexible than traditional court proceedings, offering parties more say in the final decision.
Arbitration is commonly used when both parties want a decision without waiting for a court trial; the situation is complex and they need a neutral legal expert to weigh in; and confidentiality is a priority.
Is mediation or arbitration right for me?
It depends. Both are alternative paths to litigation, providing a more collaborative way of resolving family law disputes. If both parties are willing to work together to find a solution, then mediation or arbitration could be the right fit for you.
While mediation and arbitration are great options, not every case is well-suited for these approaches. A family law attorney can help you to decide which path will work best for your specific case.
